1. Service Description
Namient (“the Service”) is a name availability checking tool that queries public registries, domain WHOIS databases, social media platforms, and other sources to help you determine whether a product name is available. The Service also provides AI-powered linguistic analysis and name generation features. The Service is provided by Namient (“we,” “our,” or “us”).
2. Acceptance of Terms
By accessing or using Namient, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time, and your continued use constitutes acceptance of any changes.
3. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Use automated scripts or bots to make bulk requests beyond normal usage
- Attempt to circumvent rate limits or abuse the Service in a way that degrades performance for others
- Use the Service for domain squatting, cybersquatting, or trademark infringement activities
- Reverse-engineer, decompile, or attempt to extract the source code of proprietary components
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
4. Accounts & Authentication
Some features require authentication via Firebase (Google sign-in). You are responsible for maintaining the security of your account. Anonymous usage is available with reduced rate limits. We reserve the right to suspend or terminate accounts that violate these terms.
5. Accuracy of Results
Namient provides name availability information on a best-effort basis. Results are based on publicly available data from third-party registries and APIs at the time of the check. We do not guarantee that results are 100% accurate, complete, or up-to-date. Name availability can change at any time. Always verify critical results directly with the relevant registry before making business decisions.
6. Intellectual Property
The Namient name, logo, and branding are our property. The probe engine and infrastructure code are open source under their respective licenses. AI-generated name suggestions and linguistic analyses are provided as-is and do not constitute legal advice regarding trademark availability or registration.
7. No Warranty
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAMIENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.
